INTRODUCTION/EXPLANATORY REMARKS REGARDING
CATALINA VISTA DEED RESTRICTIONS

Catalina Vista is unique among Tucson's older neighborhoods in that it still has an active set of deed restrictions (CCR's). Like most of the deed restrictions written in the 40's and 50's, ours contains an unfortunate provision that attempts to exclude residents on the basis of race. Under no circumstances does our Neighborhood Association Board endorse this provision. Unfortunately, while this provision has been deemed illegal and unconstitutional, our deed restrictions do not contain a mechanism that permits us to alter or amend the CCR's. At a time when many older neighborhoods are threatened by inappropriate development, our deed restrictions serve as a contractual tool for trying to preserve the quality of life for our residents. We welcome anyone, no matter their race, color or creed, who lives in our neighborhood and works to preserve the unique, historical quality that makes Catalina Vista a remarkable place to live.
